Terms of Service (EULA)

Welcome to Mindscape. These Terms of Service ("Terms") govern your use of the Mindscape mobile application ("App") and related services provided by Mindscape ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Mindscape, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Mindscape is a focus and productivity application that helps users:

  • Block distracting apps during focus sessions
  • Track focus time and productivity patterns
  • Set and achieve productivity goals
  • Access meditation and mindfulness content

3. Account Registration

To use certain features of the App, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Subscription and Payments

Mindscape offers both free and premium subscription plans:

  • Free Plan: Basic features with limited functionality
  • Premium Plan: Full access to all features, content, and future updates

For premium subscriptions:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your device's account settings
  • No refunds are provided for partial subscription periods

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Share your account credentials with others
  • Use the App in any way that could damage or impair the service

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, audio, video, and software, are owned by Mindscape and are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute any part of the App
  • Use our trademarks without prior written consent
  • Create derivative works based on the App

7. App Permissions

To provide our services, Mindscape requires certain device permissions:

  • Screen Time (iOS): Required to block apps during focus sessions
  • Accessibility Service (Android): Required to detect and block distracting apps
  • Notifications: To send focus reminders and session updates

These permissions are used solely for the App's intended functionality and not for any other purpose.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDSCAPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages arising from your use of the App

10. Indemnification

You agree to indemnify and hold harmless Mindscape, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • You must delete all copies of the App from your devices
  • Provisions of these Terms that should survive termination will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the App or sending you an email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mindscape regarding the use of the App.
